ORDERING

This catalog is provided as a reference tu guide you in selecting plant material to fill your specific needs. It cancels all previous catalogs and price lists. All prices are FOB our facilities in New lberia and Big Cane, Louisiana and are subject to change without notice.

An updated availability list can be provided by our sales staff upon request via mail, fax or e-mail. We are available tu serve your needs from 7:00 a.m. to 4:30 p.m. Mondey through Friday. If assestance is required outside these times, please ask and arrangements can be made to better serve your schedule.

Please be specific about delivery instructions and other specifications that may be relevant!

CONDITIONS OF SALE

Live Oak Gardens, Limited is a Wholesale nursery catering to the nursery and landscape trade. We do not sell to individuals for home or personal use. New customers will be required to show proof of nursery certification, landscape contractor's lincense or stock dealer certification upon initial application to purchase our plants. If the way you make a living is not directy related to the sale or installation of plants, please do not try tu buy here!

It is your responsibility tu, and we strongly suggest that you pleace inspect your plants thoroughly (both quality and quantity) at the time of receipt in order that any discrepancies can be remedied immediately. This is particulary important as no claims will be considered for adjustment unless noted on the delivery copy of the invoice. Your signature on the invoice is an acceptance of the material in satisfactory condition. In no case will our liability exceed the purchase price.

Live Oak Gardens, Limited is careful to have our plants identified correctiy; however, no warranty is given, expressed or implied as to the variety or productiveness of the plants we sell. Our liability is limited to the purchase price paid tu us. We assume no liability for failure tu deliver or delays caused by contingencies beyond our control. Nor does Live Oak Gardens, Limited provide any further guarantee as to the long term survival of your plants as we have no control of the care they receive after delivery.

CREDIT

Live Oak Gardens, Limited requires all new customers to prepay for their first order. Acceptable means of payment include: cash,cashier's check, certified check, wire transfer, credit card or company check (if given sufficient time to clear). Thereafter, any customer may apply for credit and will by given due consideration. Please call or write to request your credit application.Be sure to fill out and sign all forms in their entirety. Afte trade references are checked, applicants will be notified in writing as to their credit status and limit.

All credit accounts are 30 days net. Past due accounts (over 30 days) will be charged 1 2/2% per month or 18% per annum. Accounts having a balance over 90 days will not be allowed to charge again until the entire balance (including finance charges) is paid off. In the event it becomes necessary to engage an attomey or collection agency, 33 1/3% will be added to the invoice, with a minimum charge of $250.00.

PICK-UP POLICY

In order to better serve our customers needs, we ask that all orders be phoned or faxed in to our sales staff at least 24 hours before being picked up. We will make every effort tu have your order ready when you arrive, thereby shortening the time required for you to get back to your customers. However, durning the peak season, it may take us slightly longer to process your order as we have many other orders coming in and we try to do them in the order they are received. If you like, we can place a courtesy call to let you know when your plants are ready for pick-up. Regardless all costomers are to report to the office when they enter Live Oak Gardens, Limited property!

FIELD GROWN MATERIAL

All trees and shrubs are machine dug, wire balled and star strapped for easy handling. Field grown material must be shipped approximately 75 miles from our Big Cane location and require up to 14 day of lead time before pick-up or delivery. Please confirm that your trees have arrived prior to your arrival. B & B trees that are to be dug in periods of dry weather will take considerably longer (2 weeks or more) as sifficient water must be provided to the plants over a period of time prior to digging as well as a 7 day curing period. Your patience is appreciated in helping us get your plants off to the best possible start.

DELIVERY ORDERS

Live Oak Gardens, Limited can deliver plants to customers throughout the state of Louisiana of its own trucks. We also deliver to southeastern Texas, southern Mississippi and the lower Alabama Gulf Coast. Freight is currently being calculated on an order by order basis dependent upon mileage and percentage of load. Please contact our transportation department for more information concerning your order.

Please be sure to have sufficient unloading help and/or suitable machinery avallable at the designated drop site. Also, please be certain that the drop site is serviceable with an 18-wheel tractor trailer rig. Our truck drivers will not violate any traffic laws to reach a delivery site so please don't ask them to. Failure to meet the truck or routing the truck to an unreachable location will result in the order being brought back to Live Oak Gardens, Limited and having a restocking fee of 15% plus freight being assessed to your account. Excessive delays, due to insufficient help or lack of necessary machinery, will result in a $60.00 per hour charge which will be added to your invoice upon delivery.

Shipments to areas outside our delivery area can be arranged with independent trucking companies by you or by us if you so desire. All independent trucking fees should be paid to the trucking company involved and are not to be paid to Live Oak Gardens, Limited.

MINIMUM ORDERS

Flatted material must be ordered in full-flat quantities (no partial flats).
One gallon material must be ordered in quantities of 10 or more.
Three and sever gallon material must be ordered in quantities of 5 or more.
Larger (15 gallon, 25 gallon and B & B) plant material may be ordered one at a time.
Your order must total $200.00 or more!

CONTRACT GROWING

We would be delighted to contract grow plants of any type andany size for any of our customers. Please let us know what you need and when and we will be happy to discuss the possibilities with you!

NURSERY TOURS

Tours of our nursery facilities are available to our customers upon request. Please call ahead to schedule and make sure that someone is available to act as a guide during your visit.
